We are pleased to report that litigators Joshua Sussman and Nicole Emanuele secured two decisions on behalf of their clients, a well-established medical residency match preparation company and its founder.
The orders granted the Plaintiffs a preliminary injunction against the Defendants, a former partner and his new company, and held them in civil contempt of the Court’s initial temporary restraining order. The temporary restraining order had enjoined the Defendants from operating, and the Court had expressly rejected their request to continue to service medical students through September 24, 2025, an important filing deadline for the 2026 match cycle. Nonetheless, after the Defendants were caught red-handed, they admittedly continued to operate after the issuance of the temporary restraining order. In deciding to hold the Defendants in civil contempt and award significant monetary penalties and attorneys’ fees and costs, the Judge stated that the Firm proved Defendants deliberately disobeyed the TRO beyond a reasonable doubt. A motion for criminal contempt will be before the Court shortly.
