Weiss Zarett is pleased to announce that we successfully represented a number of physicians in a lawsuit commenced by Academic Health Professionals Insurance Association, which sought to collect medical malpractice insurance assessments allegedly due under prior insurance policies.   Weiss Zarett promptly moved to dismiss the case on the grounds that a settlement and release agreement previously agreed to by Academic barred the lawsuit. Our motion was granted by the New York Supreme Court (click here for decision), and Academic’s case was dismissed. Academic appealed.  On March 5, 2026, the Appellate Division, First Department, agreed with the Supreme Court and affirmed the dismissal against the physicians (click here for decision). Weiss Zarett attorneys, David Zarett, Michael Spithogiannis and Carissa Danesi, handled the case and are pleased the lawsuit was dismissed quickly and decisively at such an early stage of the proceedings.
