Is Your Physician Profile Up to Date?

The New York State Physician Profile (“Profile”) website was created after former Governor George Pataki signed into law the New York Patient Health Information and Quality Improvement Act of 2000, which made information about physicians available to help patients make informed decisions about their choice of doctor and treatment.

In addition to basic education and practice information, the New York Public Health Law requires a Profile list, without limitation:

1)    Malpractice award payments made in the past 10 years;
2)    Any current restrictions or limitations as a result of actions taken by the New York State Board of Professional Medical Conduct;
3)    Any criminal convictions within the past 10 years;
4)    Any loss or involuntary restriction of hospital privileges or removal of medical staff membership related to the quality of patient care delivered and where procedural due process has been afforded, exhausted or waived; and
5)    Failure to renew professional privileges or resignation from medical staff membership in lieu of a pending disciplinary case against the physician related to the quality of patient care he/she delivered.

Newly licensed physicians are required to create a Profile upon licensure in New York State. Once created, physicians are required to update their Profile within six months prior to the expiration date of their registration period. If there is change to the information (except optional information) in the Profile, physicians are required to update their Profile within 30 days of such change. A physician who fails to complete or update their Profile when necessary, may be guilty of professional misconduct. The same applies if a physician knowingly provides materially inaccurate information on their Profile. A physician should by mindful that the Office of Professional Medical Conduct (“OPMC”) receives a monthly report that identifies physicians who were required to initialize or update their profile during the previous month but failed to do so. In these instances, OPMC may contact the physician and grant a 30-day compliance period. If, however, the physician fails to comply, OPMC may refer the physician to the Board for Professional Medical Conduct for disciplinary action.
